Oproep petitie Duitsland voor het recht op verzamelen

Beste forumleden,

Zoals reeds in een ander topic aan bod komt (zie ook http://www.fossiel.net/forums/viewtopic ... icID=30096 ), komt het aanleggen en houden van een collectie in Duitsland onder druk te staan door een nieuw wetsvoorstel. Van onze vrienden op Steinkern.de komt een warme oproep om de petitie te tekenen om dit wetsvoorstel tegen te houden. Buitenlandse handtekeningen tellen niet rechtstreeks mee om het vereist aantal te halen, maar onderstrepen wel de internationale bezorgdheid rond deze trend.

De Duitse overheid is van plan om in het begin van 2016 een wetsvoorstel door te voeren om zogezegd cultureel erfgoed te beschermen. Een draft van dit voorstel is gepubliceerd op 14 september 2015, en bedreigt het verzamelen van naturalia (fossielen, mineralen, etc.), en culturele objecten (waaronder artefacten, munten, postzegels, kunst, etc.)

Zowel private verzamelelaars als wetenschappers, handelaars en beursorganisatoren zouden worden benadeeld bij deze overregulering. Vanuit de natuurwetenschappen is geen enkele representatieve organisatie gekend geweest bij de opmaak van dit wetsvoorstel. Door compleet verschillende objecten (culturele objecten en naturalia) op één hoop te gooien in één wetsvoorstel, hebben veel onaangepaste en misleidende regels hun weg gevonden naar de teksten.

Centraal in het voorstel staat een poging -van slecht geïnformeerde officials- om drastische maatregelen door te voeren met het argument om illegale opgravingen en handel ten dienste van terroristische organisaties, te ontmoedigen. Dit veronderstelde gebruik houdt geen steek en kent nauwelijks precedenten in Duitsland.

Verzamelaars, wetenschappers en handelaars zouden worden onderworpen aan zinloze import formaliteiten, die onmogelijk te organiseren zijn voor elk individueel object (het voorstel maakt momenteel geen gewag van het afzien van deze regel vanaf een bepaalde ondergrens van de waarde). Het feit dat non-conformiteit automatisch leidt tot het beschouwen van het bewuste object als illegaal, zet de poort wagewijd open voor autoriteiten om verzamelaars op arbitraire wijze te criminaliseren, terwijl het moeilijk tot onmogelijk is om aan de vereisten te voldoen. Bovendien zou de wet met terugwerkende kracht gelden, en wordt de bewijslast volledig bij de verzamelaar gelegd. Om niet te spreken van het hinderen van wetenschappelijk onderzoek door overdreven bureaucracy en het onmoedigen van het verzamelen van nieuw materiaal. Dit is virtueel gelijk aan een effectief embargo op fossielen.

Verzamelen staat volgens ons niet gelijk aan het vernietigen van natuurlijk of cultureel erfgoed, wel integendeel. Het is een belangrijk aspect in de vrijwaring en conservering van dit erfgoed voor toekomstige generaties! Wetenschappers en verzamelaar kennen binnen de natuurwetenschappen een traditie van goede samenwerking ("citizen science" ).

We pleiten voor een fundamentele revisie van het wetsvoorstel, waarbij natuurwetenschappers, verzamelaars en handelaren gekend zijn en inspraak hebben, om tot een regelgeving te komen die voor iedereen steek houdt! Ook de verzamelaars van culturele objecten dienen hierbij gehoord te worden, wat wellicht kan leiden tot aparte aanpassingen aan hun behoeften.

Natuurlijk erfgoed is werelderfgoed, en behoort niet tot het cultureel erfgoed van één bepaalde natie of staat. Beperkingen tot handel, tot uitwisselen van materiaal tussen instituten door toenemende bureaucratie zijn niet nodig voor elk object. Desondanks erkennen we dat dit wel zinvol kan zijn voor bijzondere en waardevolle objecten.

Neem aub even de tijd om deze petitie "om het recht op private verzamelingen te vrijwaren" te tekenen.

Met elke stem neemt de druk op beleidsmakers toe om op een geïnformeerde en weloverwogen manier te handelen! We rekenen op de solidariteit van alle verzamelaars van natuurlijke en culturele objecten, en van wetenschappers die hierop onderzoek doen.

International appeal to all collectors of natural and cultural objects – please sign the petition "For preserving the right to privately collect"!

The German government plans to pass a so called cultural goods protection bill in the beginning of 2016. A draft has been published on September 14th 2015 and menaces collecting of natural goods (such as fossils and minerals etc.) and cultural goods (including artifacts, coins, stamps, artworks etc. ).

Private collectors as well as scientists, merchants and organisers of fairs would be adversely affected by this regulatory overreach. No one representing the natural sciences has been consulted during the draft phase of this pending law. By aggregating completely different resources (cultural goods and natural goods) within one act, many inappropriate and misguided regulations have found their way into the paragraphs.

Central to this proposed legislation, misinformed officials ludicrously attempt to justify the need for drastic regulations by argument of illicit digging and resulting illegal trade of artifacts ultimately being used for terrorist financing. This purported use of natural and cultural goods defies both logic and historical precedent in Germany.

Collectors, scientists and merchants are threatened by
senseless import formalities which are impossible to observe for every single natural or cultural good (legislation currently makes no provision for waiving scrutiny of objects below a specified threshold value),
the fact that non-compliance of the formalities would lead directly to classification of the possession of natural and cultural goods as being illegal, making it possible to criminalise collectors by more or less arbitrary acts by the authorities,
proposed duties of care for dealers which are difficult or impossible to obtain,
highly questionable retroactive law and reversal of evidence in account of the collector. (lack of "grandfather clause" ),
hindrance of natural science by excessive bureaucracy and deprivation of sources for new material (collectors, merchants and own imports),
a virtual ban of international exchange and commerce of cultural and natural goods (e.g. fossil and mineral fairs) due to far to overwhelming and unnecessarily prohibitive bureaucratic requirements that have nearly the same effect as embargoes.

Collecting is not destruction of cultural and natural goods; it is quite the contrary: collecting is important to preserve natural and cultural goods for future generations! Scientists and collectors cooperate excellently in natural sciences ("citizen science" ).

We claim a fundamental revision of the law with inclusion of natural scientists, private collectors and merchants of natural objects to have input in proposing rules that make sense! The collectors of cultural goods need also to be heard, maybe leading to separate considerations for their pursuit.

Natural goods are world heritage and not the cultural heritage of a national state. Limitations for the merchandise traffic, for lending objects from institute to institute resulting from growing bureaucracy are not necessary for every single object; however, they may only be justifiable for certain objects above a meaningful and justifiable threshold value.

thank you very much for supporting us - this is really great and the members of the German fossil and mineral communities are very pleased that you do this for us. As Frederik said we are an international community and normal fossils should know no national borders.

The bureaucratisation has to be stopped!

I have to add that everyone who imports fossil stuff (or any other cultural or natural goods) to Germany is also potentially concerned by the law and needs papers to show that his possession is legal, if he gets controlled. This misconceives the tradition of hunting stamps, fossils, minerals etc. (normall no papers).
